Faraid al usul volume 2
Farāʾid al-ʿUṣūl is a foundational work on the principles of Islamic jurisprudence (Usul al-Fiqh) by Shaykh Murtada al-Ansari (d. 1281/1864), a prominent Shi'a scholar. Also known as Rasāʾil, this book significantly advanced Shi'a jurisprudential thought and influenced later scholars in the field. The book comprises five key treatises, structured into three main sections (maqsads) and a concluding discussion: 1. Certainty (Qatʿ) – Examines the validity of certainty as a basis for legal reasoning, including discussions on tajarri (defying rules) and general knowledge. 2. Conjecture (Zann) – Discusses the permissibility and practical application of conjecture in jurisprudence, including the reliability of Quranic interpretation, hadiths, linguistic reports, and khabar al-wahid (solitary narrations). 3. Doubt (Shakk) – Covers practical principles for cases of uncertainty, including bara'a (clearance of liability), ihtiyat (precaution), takhyir (choice), and istishab (presumption of continuity). 4. Equilibrium and Preference (Taʿādul wa Tarājiḥ) – Addresses how to resolve conflicts between opposing legal arguments and the criteria for prioritizing one over another. Farāʾid al-ʿUṣūl remains a cornerstone of Shi'a jurisprudence, shaping scholarly discourse on legal reasoning and methodology.
